       With reference to our Announcement on suspension of trading service relating to US Publicly Traded Partnerships (PTP) Securities and new withholding tax on US Publicly Traded Partnerships (PTP) Securities, which we, Krungsri Capital Securities Public Company Limited (“KCS”) previously informed you that we will suspend the service which is provided through our foreign securities broker as follows:

                         • By 14 November 2022, we will cease to accept buy orders and share transfer-in requests for PTP securities.

                         • By 29 December 2022, we will cease to accept orders (both buy and sell) for PTP securities. The last day to sell off your PTP securities through our foreign securities broker is 28 December 2022.

               We are pleased to update that we are notified by our foreign securities broker that while our foreign securities broker continues to engage US partners regarding a new provision under Section 1446(f) of the Internal Revenue Code (IRC), our foreign securities broker will continue to accept buy and sell orders, and share transfer requests for PTP securities until further notice.

               Therefore, we would like to inform you that we will continue to accept buy and sell orders, and share transfer requests for PTP securities until we receive further notice from our foreign securities broker. Notwithstanding our continued service, please be reminded that with effect from 1 January 2023, there may be an additional 10% withholding tax applied on gross consideration on sales of PTP Securities to you as per IRC Section 1446(f). If you are holding any PTP securities, in accordance with the suggestion provided by our foreign securities broker, we suggest that you review your investment portfolio and take appropriate actions to avoid the possible impact of holding such securities from 1 January 2023.

               Further updates may be expected as our foreign securities broker get more clarity from its U.S. partners.

               Please refer to the attached possible list of PTP securities provided by our foreign securities broker based on external sources. Kindly note that it is not an exhaustive list of all PTP securities that are in scope for Section 1446(f). The list may be subject to change from time to time without prior notice. KCS and our foreign securities broker assume no responsibility for the timeliness, accuracy and completeness of this list. You may be claimed for the withholding tax to satisfy the IRS withholding requirements in case of the sale of security (from 1 January 2023 onwards) which is not listed in the provided PTP list but falls under PTP classification.
